1. Introduction
Welcome to scita.health ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of the Scita Health website (scita.health) and our WhatsApp-based companion service Scita ("the Service"). By accessing the website, joining our pilot programme, or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
Scita Health ApS is a Danish private limited company (Anpartsselskab) registered in Denmark under CVR no. 46117131.
2. About the Service
Scita Health is a precision prevention platform supporting women navigating perimenopause and menopause. Our Service includes:

Educational content about perimenopause and menopause

A WhatsApp-based companion (Scita — "she who knows") that provides personalised insights based on the data you share with us

Optional integration with wearable health devices (such as Oura, Garmin) where you explicitly grant consent

Summaries and informational guidance derived from your inputs
The Service is currently in pilot phase ahead of a planned randomised controlled trial. Features and availability may change as the Service evolves.
3. Not Medical Advice
The Service is for educational and informational purposes only. It does not provide medical diagnosis, treatment, or professional medical advice.

The Service is currently in a pilot and research phase and is not a CE-marked medical device. It is not intended for diagnosis, prevention, monitoring, prediction, prognosis, treatment, or alleviation of disease within the meaning of EU Regulation 2017/745 (Medical Device Regulation).
Any decisions about your health, medication, or treatment should be made together with a qualified healthcare professional who knows your individual medical history.
4. Eligibility
To use the Service you must:

The Service is not directed at children. We do not knowingly collect data from anyone under 18.
5. Pilot Programme Participation
During our pilot phase, participation is by invitation or opt-in via our website. By joining the pilot you agree:

You understand the Service is in a development phase and may change, be paused, or be discontinued

You consent to receive WhatsApp messages from Scita Health as part of the pilot

You can opt out at any time by replying STOP in WhatsApp or contacting us at hello@scita.health

We may contact you for feedback on the Service

Your participation does not create any employment, agency, or partnership relationship with Scita Health ApS
6. Your Identity and Conduct
The Service is delivered primarily over WhatsApp; your phone number (and, where applicable, magic-link tokens or other access mechanisms we provide) serve as your identity on the Service. You are responsible for:

Keeping confidential any access tokens, magic links, or credentials we issue to you

All activity that occurs under your phone number or account

Providing accurate, current, and complete information

Notifying us promptly of any unauthorised use of your account or phone number
You agree NOT to:

Use the Service for any unlawful purpose or in violation of these Terms

Attempt to gain unauthorised access to any part of the Service or its underlying systems

Interfere with or disrupt the Service

Use automated means (bots, scrapers) to access the Service without our written permission

Impersonate any person or misrepresent your identity

Resell, sublicense, or commercially exploit the Service
7. WhatsApp Communications
The Service is delivered in part through the WhatsApp Business Platform. By using the WhatsApp-based companion:

You acknowledge that WhatsApp messages are processed by Meta Platforms Inc. (operator of the WhatsApp Business Platform) and by our messaging infrastructure provider Twilio Inc.

8. Intellectual Property
All content, branding, software, designs, text, and other materials on the Service are owned by Scita Health ApS or our licensors and are protected by intellectual property law.
You may not copy, modify, distribute, sell, or create derivative works from our content without our written permission, except for personal, non-commercial use of materials clearly intended for sharing.
Content you submit to the Service (messages, feedback, self-reported information) remains yours. You grant us a limited licence to process this content as needed to provide the Service and as described in our Privacy Policy.
9. Privacy and Data Handling
Your privacy is governed by our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy describes what data we collect, how we use it, and your rights under GDPR.
By using the Service you acknowledge that you have read and understood our Privacy Policy.
10. Disclaimer of Warranties
The Service is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including but not limited to:

The Service is in a pilot and development phase. While we apply reasonable care, you should not rely solely on the Service for any health-related decision.
11. Limitation of Liability
To the maximum extent permitted by Danish and EU law, Scita Health ApS, its directors, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Service.
Our total aggregate liability to you for any claim arising out of these Terms or your use of the Service shall not exceed one hundred euros (€100).
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be limited or excluded under applicable law.
12. Indemnification
You agree to indemnify and hold harmless Scita Health ApS from any claims, losses, liabilities, damages, and expenses (including legal fees) arising out of your breach of these Terms or your misuse of the Service.
13. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or for any other reason at our discretion.
You may stop using the Service at any time. You can request deletion of your personal data per our Privacy Policy and GDPR.
14. Changes to These Terms
We may update these Terms from time to time. We will notify users of material changes by posting the updated Terms on this page and updating the "Last Updated" date. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
15. Governing Law and Jurisdiction
These Terms are governed by the laws of Denmark, without regard to conflict of law principles. Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Denmark, subject to any mandatory consumer protection rights you may have under your country of residence.
